'capital punishment', that is they get seized, their asssets sold, their executives dismissed without their 'golden parachutes'. As 'legal persons' (since Citizens United) they should face the same penalties as persons for crimes like murder, reckless or depraved indiffereence murder (which applies in most employee death cases) So Massey, BP and Union Carbide, should by rights, have faced corporate death.

    •  you're thinking Santa Clara v. Southern Pacific RR (0+ / 0-)

for the origin of corporate personhood.

Roscoe Conklin... he's the Republican Congressman turned RR lobbyist to blame for most of the legal protection corporations get in this country.

    •  Intermediate Sentencing (0+ / 0-)

Having booted the Board and seniors unceremoniously booted with no parachute and potential for arrest (actual arrest in cases in case of flight risk), I'd begin with workers temporarily laid-off with packages and free retraining. then freeze ALL other assets, pending God's own audit.

Then the company would be subject to radical repurposing for time XXX, with any/all profits going into various social, medical and infrastructure services.

At the end of the sentence, the temporary management would be removed, and the company would be cut loose and sent back out into the world with a sum of money equal to that shown on its last pre-sentencing tax return.

I am a bleeding-heart liberal. Deal with it.
