Posting a Diary Entry

Daily Kos welcomes blog articles from readers, known as diaries. The Intro section to a diary should be about three paragraphs long, and is required. The body section is optional, as is the poll, which can have 1 to 15 choices. Descriptive tags are also required to help others find your diary by subject; please don't use "cute" tags.

When you're ready, scroll down below the tags and click Save & Preview. You can edit your diary after it's published by clicking Edit Diary. Polls cannot be edited once they are published.

If this is your first time creating a Diary since the Ajax upgrade, before you enter any text below, please press Ctrl-F5 and then hold down the Shift Key and press your browser's Reload button to refresh its cache with the new script files.

ATTENTION: READ THE RULES.

  1. One diary daily maximum.
  2. Substantive diaries only. If you don't have at least three solid, original paragraphs, you should probably post a comment in an Open Thread.
  3. No repetitive diaries. Take a moment to ensure your topic hasn't been blogged (you can search for Stories and Diaries that already cover this topic), though fresh original analysis is always welcome.
  4. Use the "Body" textbox if your diary entry is longer than three paragraphs.
  5. Any images in your posts must be hosted by an approved image hosting service (one of: imageshack.us, photobucket.com, flickr.com, smugmug.com, allyoucanupload.com, picturetrail.com, mac.com, webshots.com, editgrid.com).
  6. Copying and pasting entire copyrighted works is prohibited. If you do quote something, keep it brief, always provide a link to the original source, and use the <blockquote> tags to clearly identify the quoted material. Violating this rule is grounds for immediate banning.
  7. Be civil. Do not "call out" other users by name in diary titles. Do not use profanity in diary titles. Don't write diaries whose main purpose is to deliberately inflame.

Official War on Christmas Fundraiser

Over the past 10 years, we've raised more than $10 million at Daily Kos for Democratic candidates. We plan to keep doing so, getting better Democrats into office across the country. But to make it happen, we now need to raise some money for the site itself. You can read Markos's post about why this is necessary here. One great thing about our Official War on Christmas Fundraiser, you can help the site at the same time you help yourself or someone you know by buying a subscription. Or, if you already have a subscription or wish to contribute more than a subscription costs, you can simply donate here. Thank you for all that you do.

Today in America:

Argument over Sandy Hook shooting ends in gunfire:

[A] patron at the All Cuts Barber Shop in Wentzville, Mo. remarked Tuesday that he wanted to kill the suspect, Adam Lanza — who is already dead. Somehow, inexplicably, 57-year-old Lester Davis was offended and took the comment as a threat, asking, "You want to murder me?"

Police say Davis then went to his car, got a pistol and fired three shots at the unnamed customer. Fortunately no one was injured.

Man Arrested at Sandy Hook Elementary in Virginia:
A man was arrested at Sandy Hook Elementary School in Strasburg, Va., Wednesday, according to the Shenandoah County Sheriff’s Office.

The 33-year-old walked into the school with a 4-foot long two-by-four labeled “High Powered Rifle” about 11:40 a.m., the sheriff’s office said.

He was met by school staff, then detained by a sheriff’s school resource officer. He was arrested and taken into custody without incident.

Boy finds gun in movie theater during 'Hobbit' field trip:
A group of seventh-grade students on a field trip to see The Hobbit found a loaded gun in a movie theater Wednesday morning. [...]

Tillamook police Chief Terry Wright said officers took possession of the gun. It was a small caliber, fully loaded, semi-automatic pistol with one round in the chamber. The safety was off.

Meanwhile, in the Senate:
In the wake of the Newtown shootings, Senate Commerce Committee Chairman Jay Rockefeller introduced a bill Tuesday that would have the National Academy of Sciences examine any link between violent video games and media, and violent acts by children, industry sources say.

Blast from the Past. At Daily Kos on this date in 2007Due process at Guantánamo:

There was an important development on Tuesday at Guantánamo. A ruling by the judge in Salim Hamdan’s military commission appears to require entirely new hearings for any prisoners who claim to be POWs. Hamdan had appealed for a POW status hearing under Article 5 of the Third Geneva Convention. The ruling by Navy Captain Keith Allred went strongly in his favor.

Allred rejects the Congressional view that Combatant Status Review Tribunals had been adequate to determine POW status. That view was asserted forcefully by Sen. Lindsay Graham in 2006 during hearings for the Military Commissions Act. Allred, however, concludes that CSRTs concerned themselves with whether the prisoners were "enemy combatants" and therefore weren’t competent to determine whether the men were prisoners of war.

The military commissions are defective by design and should not be permitted to stand in for civil trials, but at least one prisoner has been assigned a judge who is willing to face up to the plain flaws in the legal "system" that the Bush administration slapped together.
