This topic may have been addressed in previous diaries but it is important to note the extreme reaction of the right as to Bush's actions in violation of the warrant requirements of the FISA law. In fact, FISA is not at issue, the 4th Amendment is.
Admission: I'm a lawyer, albeit one who is long away from ConLaw and although practicing, doing so in an area that does not involve issues involving the Constitution. So, I welcome the contributions/corrections of those Kossacks who know this area of the law much better than I.

In my opinion, Bush and his media presstitutes are anxious to get in front of this NSA story not because of violations of the FISA legislation. They are nervous because their actions are in violation of a principle of law that goes back nearly 1000 years to the reign of Henry II of England; i.e. the Fruit of the Poisoned Tree. This principle can be explained in a single sentence and is embodied in the 4th Amendment to our Constitution: Evidence obtained in an illegal search is inadmissable in a court of law.
