Yesterday, I wrote a diary about the Anti-Counterfeiting Trade Agreement (ACTA), whose details are being presently worked out.
The reason I was writing about it was because the Obama White House has prevented individuals and groups such as the Electronic Frontier Foundation (EFF) from seeing any drafts or details of the treaty while it is being written and revised.
The reason? Because it has been "classified in the interest of national security pursuant to Executive Order 12958." Wow, national security, eh? Must be pretty secretive! Except now we know who can see details of the treaty, and it reads like a "who's who" of lobbying groups.
Thanks to Knowledge Ecology Notes, who posted this link to the Office of the US Trade Representative, we can get a pretty good idea of who has access to the ACTA treaty in its formative stages.
The Treaty, and numerous other documents, are accessible to numerous "cleared advisors," of whom many are corporate lobbyists. Let's take a look at just some of the "advisors" who have access to the treaty in its formative stages.
This is a list of advisors from just four of the 27 advisory boards who have access to the treaty:

There sure are a lot of people from various industries (including the MPAA and RIAA) who have a say into the formation of this treaty, or can at least read it while it's still in its formative stages.
And what about the Americans who are not members of giant transnational corporations, or even the large public advocacy groups like the EFF? Nope, we can't, because this treaty is somehow considered related to national security.
Sure, this treaty might be made public when the Senate finally has to ratify it, but by then, it would conveniently be too late to make any amendments or alterations. We're all stakeholders in the outcome of this, and thus, letting corporate lobbyists have the only influence to begin with is absolutely unfair. But using this fake "national security" ruse is disingenuous at best.
One of the reasons Barack Obama won was because of his pledge for cleaner, transparent government. Reverting to the old notion of hiding everything under the guise of national security is a disturbing sign. And thus I call on Barack Obama to either very specifically detail how keeping this treaty secret is providing for our national security (and no, making sure Warner Bros. gets more money for the next Batman movie does not qualify as national security), or to drop the secrecy around this treaty. If nothing else, get a couple well-known groups like the EFF to have their say.
