Is no one else confused as to why Fox News has not mounted a legal challenge to the FOK News logo as being confusingly similar to its logo, with respect to trademark and/or trade dress?
Less confusing marks/dress have triggered lawsuits; for example, Rockstar has sued a competing energy drink, Rock on for trademark infringement.
Given the propensity to protect intellectual property rights with fang and claw, it is a curiosity to me. On the other hand, maybe the hesitance is based on the hurdle Fox must clear in establishing that anything Fox does is "intellectual." But I doubt it. That hasn't inhibited a lot of cute but vapid stuff from seeking protection, e.g., this thing.
Maybe it's just that the wheels of justice have not been cranked yet, but I have a theory as to the delay. What if Fox is reluctant to sue because it would give immediate notoriety to FOK? As we all know, notoriety is a magnet for TV audience. I present Charlie Sheen as exhibit A. Could FOK be inviting a lawsuit, like B'rer Rabbit begging to be thrown into the brier patch?
