today, in santa monica, a los angeles county judge signed an injunction against goldline, inc - the sponsor of such "luminaries" like glen beck, sean hannity, lars larsen, monica crowley and a whole bunch of other nutcases.

it seems that goldline has been duping seniors by claiming that the u.s. government is going to recall all the gold bullion - but IF the same seniors buy overpriced "collectible" coins from goldline, the mean ol' guv'mint can't take those away from their gnarled fingers!

the judge says that goldline has to refund $4.5 million to the folks who want their money back!

when i've heard the goldline pitches, i have a hard time not laughing hysterically since only someone who is seriously mislead or deluded buys gold when it is this artificially high in price.

when i started making jewelry about 13 years ago, the price per troy oz was under $250.  the speculators have now pushed gold over $1,770 (as per the kitco spot market priceright now).  (and you wonder why so many jewelers are going out of business?)

added to this scam are the rantings of madmen like beck who make a small fortune by convincing the gullible that all gold is going to be confiscated (hold on to your fillings! bury the gold/silver/platinum in the back yard so the government can't come and take it!).

well, it seems that santa monica city attorney marsha moutrie decided to call out goldline.  she filed a 19 criminal count suit in november, 2011 against the santa monica based company, goldline international, inc, in superior court for targeting seniors with "false and misleading sales techniques" to persuade them to buy marked-up gold coins.  and, today, a county judge issued and injunction against the liarscompany.

here's part of the complaint from the courthouse news service wed., feb. 22, 2012.

 
     "Since in or about February 2008, Goldline has trained its salespeople to use, and they have used, false and misleading statements and omissions to intentionally conceal Goldline's more than 50 percent price markup over its buyback price for the marked-up coins.

     "Since in or about February 2008, Goldline has offered gold bullion for sale, and collected payments from consumers while promising them gold bullion products, without intending to give them the promised bullion products. Once this money was received, Goldline has persuaded the consumers to instead purchase the marked-up coins using false and misleading tactics including those described above."

     Unlike gold bullion, pricing of gold coins can be problematic because they come in various weights and sizes, according to the complaint. That frees Goldline to inflate the value of the coins without detection, the state claims.

the judge ordered goldline to refund $4.5 million and put another $800k into a special fund to cover future refunds in exchange for dropping the criminal charges. (goldline wanted to substitute the gold coins they sold for more gold merchandise... duh!  that went over like a gold-plated lead coin!)

the markup on these "coins" was 50%.  sadly, only 43 goldline customers were identified as being unhappy.  wow.

the courthouse news service also mentions beck's "pitch" for the company here...

    The criminal complaint created a stir when it was filed. ABC News reported that Goldline had "used endorsements from Glenn Beck and other conservative icons to sell hundreds of millions of dollars in gold products to consumers."

     Beck has pitched for Goldline on his radio show, which has been a sponsor of the show. Beck echoed the company's claims by citing in Goldline promos that under FDR's 1933 executive order the federal government would take all gold, except antique coins.

     Beck is not named as a defendant in the lawsuit and has not been accused of any wrongdoing.

and who else did the paranoid right wing pitch of "the big ol' bad guv'mint is gonna take your gold!"?  according to the article,
    Other prominent conservative radio hosts, including Sean Hannity, Lars Larson, Mark Levin and Monica Crowley also promote Goldline on the company website, goldline.com.

     Beck did not immediately respond to an emailed request for comment.

but, back in july, 2010, beck was squealing loudly, blasting abc news for covering the original charges.
"They are going to nudge the gold industry out of business," Beck said during his syndicated radio program Wednesday morning. "They are going to regulate it and regulate it and regulate it, until you won't be able to buy gold anymore. This is what I'm telling you -- they can't have people buying gold. They need to own all the gold. They're going to nudge us. Mark my words."

"ABC has done this story on Goldline and me, and there's nothing new there," Beck said. "Absolutely nothing new there."

Goldline agreed to an injunction that requires the company to "change its unfair sales practices" and to disclose price markups in recorded telephone conversations with customers, said Adam Radinsky, head of the Santa Monica city attorney's consumer protection unit.
 (first clue:  don't buy gold from telemarkets who call you at home!)

and, of course, goldline is not happy about being forced to "change their business model...

Radinsky [who heads the consumer protection division for the Santa Monica City Attorney] said the settlement of the civil lawsuit "has tremendous benefits for consumers." The agreement calls for a third party to monitor the injunction and make sure the company is disclosing the markups, through undercover buys, recorded telephone calls and meetings with employees.

"The company is being forced to change its entire business model from one based on misrepresentations to one providing accurate information, including price markups for each transaction," Radinsky said. "There are extreme benefits to consumers from the injunction in the civil case."

In late 2011, the Santa Monica City Attorney's office filed a criminal complaint alleging that Goldline was running "a bait and switch operation," according to a statement released by the City Attorney's consumer protection unit. The City Attorney alleged that Goldline misled customers by falsely telling them the government could confiscate gold bullion, but not the costlier coins. And the city alleged that Goldline customers were paying more than 55 percent over the actual value of the coins, mark-ups that were concealed by Goldline's salespeople.
and you thought car salespersons were bad... (disclaimer: i used to SELL cars - and all my customers were very happy - because i showed them the REAL numbers for their purchase BEFORE they bought their cars!)

sadly, i don't think this will change the minds (what little there is to them) that follow beck, hannity and more.

        I would love for someone to ask Hannity or Beck how much they personally "invested" in the overpriced commemorative coins.  

        I always marvel at how much Hannity and Limbaugh et all are ripping off their own audience when they push the line "America has the best healthcare in the world!" Sure, for them, since they are millionaires. I actually once heard Limbaugh wonder without a trace of irony why people just didn't pay for medical care out of pocket like he did.

            i'm guessing that they don't say they personally have purchased from goldline - just that goldline and gold is a good investment.

            actually, it IS a good investment - IF you buy from an honest dealer when prices are low!

            btw, never never never buy jewelry or diamonds as an investment unless you are buying gold coins at spot price.  jewelry resale gold is worth a fraction due to the labor of the pieces and karat weight (14k, 18, 22k - which is the highest any jewelry buyer will compute - even if you know it is 24k).

            then there are diamonds....

            ONLY graded diamonds of D, E, and F are traded on a fixed market price - anything below an F is wildly variable in price because it is not set internationally.  also, GIA standards are higher than EGL.  

            okay - getting too techy here.  still up - my precious old samoyed is having a rough night - so i'm wide awake.  not sure how much longer i'll get to keep him with me - he is slipping so quickly this last month.  well, at 15, he's been a wonderful "investment" - in love...

              I think of jewelry as something like wearable micro-sculpture, and I haven't enough of a clue about the market in precious metals or diamonds or any of that, to do anything about it.

              In the geek subculture it's all about developing skills and having the tools to put them to use.  In my market niche it's about inventing stuff or at least having the engineering chops to build stuff that the big guys can't.  This hasn't made me rich but it's kept my ass above the alligators at times when the rest of the economy has been down the drain.

                last night.  neither of us got much sleep...

                he is nearing the bridge - my job is to make sure he stays because he feels okay, not to just "make me happy".

                last night, after much stirrings and uneasy, restless pacing, i had the idea to pull out all his "toys/babies" for him.  

                wow.  i had no idea how many he had - one stack was almost a foot high and a foot square - another spread over 2 feet square by his bed.  it worked.  he settled down to squeak happily on a number of his "friends" for about an hour then he went to sleep.

                right now, he is sacked out beside me - totally worn out from last night's wanderings.

                every day i have had him since he was diagnosed with diabetes in jan, 2009 has been a blessing and a gift.  now we're working on SPECIAL extra days.

                i wish we could keep them forever...  sigh.

                    buffered aspirin and he is much brighter and more mobile tonite.  he is old enough to outlive any potential side effects from the aspirin (liver, kidney damage) and the benefits of being much more comfortable and mobile is worth giving him the pain meds.

                    i am much more relieved tonite than last nite - and i thank you very much for your words of consolation.  

                    i agree with you that they are never here long enough - but, to myself, i repost a friend's comment about what her dad told her when she was a child and lost her beloved dog.

                    he said, "because there are so many of them and so few of us, god only gives each one of the a little time on earth so there are enough of us to go around."

                    with this in mind, i've been watching a beautiful 3 1/2 year old sammy at sfsr rescue that had one eye removed due to glaucoma and the other eye needs drops 2x a day (not so much different than required insulin, no?).  she's been up for adoption for several months - and when the time comes, if she is still looking for a forever home, i'll be calling them.  after all, i've had (so far) a blind cat, a blind horse and a blind dog - this little girl still has one eye working but if she loses that, for me, it is not an issue.

                    in the meantime, tee is happily squeaking his "babies" beside the bed - dragging out the over 100 "toys/babies" last nite has worked some serious magic with him - he still sez he has  lotz of toyz to squeakz still... so i'm encouraging him to keep working on the entire bunch!

                      Even though I have two apparently healthy and not aged (11 yr old & 4 yr old) pooties here, I've been to the end with enough of their predecessors. Even though it hurts, we keep coming back for more. I guess the happiness outweighs the pain.

                      And I wish there were enough of us to go around, but no one would tell that to a child.

              should not be bought as an investment.

              Even if it's got gold and jewels on it, the only real value is whatever the gold and jewels can be sold for, and that's variable. The 'investment' value of it as a collectible it totally up for grabs.

              Unless it's something that's museum quality, many years old, or you just get lucky, it's highly unlikely you'll ever get even what you paid for it.

              Think dolls, plates, coins, stamps, beanie babies...

              Yes, in the case of toys or comic books, if you hang on to them for 50+ yrs and they were thought of as disposable and for some reason they become highly collectible, you might get lucky.

              But that's a rare case. And since everybody seems to hang on to everything nowadays because they're sure it's worth a fortune, less likely every day.

                jewelry into trade value for my wedding ring at the jeweler, so it was an acceptable investment for her.  She just wasn't aware when she purchased the items years ago just what they would be turned into.

                ring - it is pawned for the gold weight (plus the "weight" of the stone, not the quality)  pennies on the dollar!

                when buying investment diamonds (or ANY diamonds, for that matter, that cost over $3-5k), do NOT buy a "set" stone - the prongs can hide flaws that render the stone a fraction of what the price really is.  buy loose from reputable stone dealers - then have it set.

                and, the other "gimmick" with diamonds is the collective karat weight of a piece of jewelry.  1 karat of individual 3pt diamonds are NOT the same value as a 1 karat single stone  4 stones of .25 karats is a fraction of worth of two 1/2 karat stones.

                and, as for beanie babies - i remember the frenzy - had the ability to buy wholesale for resale - but chose to let my pup have that $300  "princess" baby instead.  i couldn't see ripping off a young person for a cheap toy with a tag.

                real investment stones (like alexandrite - natural - and the tanzanite sold before the government took control of all the mines - very dark purple) are kept by the stone wholesalers for themselves.  it is "money in the bank" for them as the stones are so rare and there aren't more readily available.  that is what gives diamonds their value - really good ones are very very rare.

                one more tip to watch for with unscrupulous dealers - any "jeweler" that tells you the "colored" diamonds have a grade of "D, E or F" are scamming you.  colors in diamonds render their grading as "fancy" - not a letter grade.

                and, many colored diamonds have been treated (irradiated) to change the color refraction.  

                again, know who you are dealing with - get real certification from the GIA (gemological institute of america).  bottom line, as in politics, be an educated "consumer".

                  Any thoughts on the availability of synthetic diamonds affecting price? I recall hearing a few year ago that someone had a process to make synthetic diamonds, but they were almost always colored (fancy, although perfect otherwise). Great for industrial uses, but not so much investment.

                    i love jade.  jade (specifically jadite) becomes more translucent the more you wear it - and it has the incredible depth that opals have, only the same color.

                    alexandrite (the real ones, not cultured) go from blood red to deep green according to how the light hits the stone.  the same with tanzanite - the good ones are deep purple to blue to reddish in color.

                    i love stones - even fluorite, although it is so fragile and will shatter if you drop it.  fluorite has fascinating properties in that the colors change due to who is holding the stones.  some people will cause the stones to radiate more purple, yet when they hand the same stone to another, it may change to green or blue or even clear!  (the electricity emanating from each individual varies and affects the soft crystals to bring out different colors).

                    yep - stones - nature's beauty!  and, for the person (me) who used to think diamonds were "cold" until i saw the searing hot light of the star of africa (in the queen's sceptre),  now i understand that every stone has it's own beauty and radiance - just like pets and people, yes?

              I'd go so far as to tell everyone here not to buy gold from anyone who advertises on the radio or the Internets.

              Sad to say, there are liberal radio hosts who have gold companies as sponsors, too. They might be slightly more honest than Goldline, but you still shouldn't buy from them. If you want to buy physical gold (and I agree with edrie, it's still a good investment, though at today's prices I think there are better ones), buy from a bank or a jeweler you know personally and have confidence in, and buy only 24k modern coins issued by actual governments: krugerrands, maple leafs, etc.

              Same thing is true if you decide to sell gold. If it's not coins such as those I mentioned, you should check the spot price for the day (see the link in the diary) and determine the karat beforehand if possible. (look for tiny stamped numbers, with a magnifying glass if necessary).

              Have the buyer weigh the metal and calculate the value in front of you, and tell you ahead of time what commission they will be taking. Commissions can range anywhere from 2% to 20%, though you're not likely to find anything near the lower figure unless you can sell to someone "in the trade", who only deals with other people in the jewelry business.

                and, even with stamped karat weights on jewelry, it is not uncommon for people to fraudulently stamp 14k on gold plated silver or white metal.  know the "feel" of the weight of gold at each karat.

                funny story here - years ago when i was seriously into buying and selling older gold jewelry, i was in a thrift store and saw a gold bracelet for $200.  asked to see it and held it in my hand.  said to the counter person, "HMMMMMmmmmm, doesn't "FEEL" right!  could you hold this for me for a few minutes?"

                then i went out to my rv and got my gold test kit (i had 10k to 22k - you can't test for 24k, 22k is the highest acid you can buy).  i went back in and tried 14k - and, yep, it came up positive.  so i said to the clerk, "STILL doesn't "feel" right..." - so i tested for 18k... and, you got it, STILL came up positive.  but i didn't like the "feel" so i tried 22k and got the hit for yes.  it was from either india or china and was 22+k for $200.  i didn't have a buyer and didn't like the design so i said to another woman standing near me, "HERE, try this on!"  it fit and her eyes just glowed.  i pointed out that there was a 20% senior discount and said "you should BUY this since it wholesales for over $1500 (at the $249/oz) price."

                she was stunned that i wasn't buying it ( since i didn't have a buyer for it, it would have been "dead cash" that i could better spend on findings and items i COULD turn over quickly).  she bought the bracelet for $160 + tax and walked out with her mouth still gaping and her eyes sparkling like the bracelet.

                that's what i love about what i do.  i don't NEED to buy everything - just to help things find the right home!

I have had the unhappy task of telling a friend that the piece they thought they'd be getting hundreds of dollars for was not gold, more times than I wish. So, since you brought it up, the Kossacks reading here should also know that if they aren't sure where the piece comes from, or if they know it's from outside the US, the stamp may not be reliable.

                  Unfortunately I've never had an experience like the one you described, and that was very gracious thing you did. I did once have a broken "white gold" bracelet to sell that felt waaaay too heavy. When I turned my (acetylene) torch on it I couldn't melt it. It turned out to be platinum, and that was a few years ago, when the platinum price was still higher than gold. That was a happy client!

        i have a friend who always bought gold coins (when the price ranged from $250 - $300.  he sold the coins when he needed money - and he always made a fair profit by choosing when to sell.  it USED to be a decent investment if you bought from reputable dealers.  goldline (and beck, hannity, etc.) are not.

        not all their customers come from fox/beck/etc.  they advertise in many venues that appear "legit" - so good people got snookered.

        like all republican scams, though, the ones who got hurt the most were the most vulnerable.

        thanks to the santa monica attorneys and customer protection unit, this company has been held accountable.

          Hell yeah.  And yes it does suck when some older person gets snookered into this shit, particularly for a large sum of money they'll need to live on, or that they could have bequeathed to their offspring, who may not be right-wing nuts.  

          And yes, it used to be possible to invest in a lot of things, before the overpopulated economic ecosystem gave rise to more parasites and predators than a trip through a malarial swamp full of mosquitos and alligators.  To my mind the most worthwhile investment for anyone of working age, is in their skills (see also community colleges: very affordable) and in their tools (good tools are worth the extra cost).  In other words, hard work still wins at our level in the economy.

          As for "admitted no wrongdoing," that's disgusting and it ought to be revoked by legislation.  No settlements without a full admission of wrongdoing.  Not necessarily an admission of having committed the crimes that were charged (after all, juries and trials etc.), but at minimum an admission of having done unethical behaviors.  "We were wrong, we bilked a bunch of old people" etc.   And make them put it on their web pages and advertisements.  "We were wrong, we bilked people, but we paid a stiff penalty and we've promised to do business ethically from now on."

          F--- 'em if they end up going out of business due to that, they damn well should.  Liquidate all of their assets, liquidate the personal assets of the principal owners & executives.  And then all the people involved should be kept under some kind of surveillance, at least as far as having to report whatever employment they have for ten years after that.  So if they try to start another scam, whoever is watching them can catch them before they cause any more damage.

          Really.  Con artists are scum and they deserve to be stripped of everything they have, if nothing else as a deterrent to others.  As for the biggest ones (Goldman), nothing short of long prison terms will do, and they can be glad when they get locked up in cages rather than torn limb from limb by angry crowds of their victims.

              This is something I have never understood:

              There is a whole layer of the criminal world who are not oppressed minorities without options, not economically disadvantaged to start out, not kids with attitudes doing mildly naughty stuff for thrills, and not looking at Goldman-like sums that would screw up most peoples' objectivity in five minutes.

              These are people with enough advantages and access to capital that they could as easily have gone into business doing anything legitimate, and earned a decent fortune doing so.   But instead they go for the scams and all that shit.  It makes no sense.   Any extra money they get from that, comes with the price of constantly having to look over their shoulder to see if the cops are closing in.  

              It's as if they have some kind of brain defect, and in all probability that's what science will ultimately find, because there's no good explanation for their behavior otherwise.

      who bought yahoo opening day - when you see a profit margin you are comfortable with, take it.  don't worry if it goes higher and you "miss out" - look at your original investment.

      when it does fall, it will be fairly rapid.  people will start to take the profit and others follow.

      my friend bought $1500 worth of yahoo at around $15 a share and sold it at over $350.  several days later it hit $400 - then within hours plummeted.  

      i follow the spot gold prices out of morbid curiosity. i don't think it will drop in the very near future, but it is definitely topping out.  i doublt it will last if it hits $2k an ounce - the temptation to pull for profit will be too great for the professional investor.  

      the little guy is the one who will miss the high spike.

      the link in the diary to kitco is a good one - or just google live precious metal prices for a realtime graph on prices around the world.  it briefly hit $1800 to day then dropped to just above $1770.  look at the patterns.  the other issue is having the ability to "sell" immediately.

      for most of the owners of gold, that means going to the local gold dealer (if you have bullion or troy oz coins purchased from a legit dealer.  the normal down for selling is 10% off spot price. (or, that's what it was a few years ago).

      the real issue is when do you want to take your profit.  you can't "lose" money other than what you invested - it is just how much you want to make and how willing you are to risk the current "profit".

    did all the sales over the phone, made promises, shipped some coins to the other state but "held" most of the coins etc

    The problem with a lawsuit is the family member has since passed so cannot verify what was promised, etc.

    I wonder how many families are in a similar situation which could explain the low number of claims in the lawsuit.

    So in trying to create something valuable to pass down to the next generation, so much money was lost.

    In this case, it just means what someone will pay for the object. Now, gold does have some utility in electronics, due to its great conductivity and low noise, but the amount used is not exactly huge. Sure, it is used to make jewelry, but that is only worth what someone is willing to pay. A lump of gold lying around doing nothing isn't really contributing much.

      some of the most amazing pieces i ever saw were by the scythians (6th - 7th b.c.) - cast in such detail that you needed a magnifying glass to see the detail.

      check out these pictures from the hermitage museum.  the collection left russia and came to the metropolitan museum in ny when i lived there.  i still vividly remember the pieces and was struck by how advanced the scythian society was to have made such beautiful and delicate pieces.  totally changed my view of "early" civilizations - made me realize that they were extremely advanced back then - not the stone clubbers wearing animal skins that was portrayed by many "christian" stories.

      mint.  it splits the legitimate trade of rare coins with minting "non-circulating" coins for foreign governments and for "collectibles".  that is where the rip-off comes in.

      "commemorative" coins are worthless except for the emotional value.  i don't need a "commemorative coin" that is simply a souvenir of some event or place.  the supposed "value" is based on what the seller convinces the buyer the coins will be "worth" at some point down the road.  that rarely ever comes to fruition.

    I've been ranting about this very thing, this very company for at least a year in less bloggy settings. There's simply NO WAY the little old man who buys into this shit is EVER, EVER, EVER, EVER, EVER going to turn a profit. All he's doing is helping to drive up the price of gold so that somebody who already bought millions of dollars of that shit when it was $400 an ounce can get even MORE millions of dollars.

    The guy on the street doesn't BUY bullion at market value. He buys it at more. And he sure as shit doesn't SELL it at market value either. He's lucky to get 50%.

    This is a total, fucking predatory scam, feeding off the fears of lower income americans.  Fucking assholes need to be strung high.

      this is so wrong - but it is a symptom of the reagan/bush greed/deregulation/anything goes/no holds barred push by the conservative/republican "business majors" who found a way to bilk the rest of the country.

      the people who are preyed upon grew up when honor still had meaning - when good grades were earned, not "purchased" (how much will you charge to write my term paper/thesis/take my sat exam, etc).

      these people are vulnerable because "morality" in their day meant that one's word was one's bond (my philosophy instilled by my parents).  they are still living in a "moral" past that wasn't corrupted by the jim bakker, glen beck, etc..

      ronald reagan was their "hero" because they had grown up watching him perform and believed the hollywood image, not the real disgusting person behind the celluloid image.

    One very nice and respected jeweler in this area is also jogoing for a slice of that market, but with a bit more class.  In fact, one of their ads says, "If you want to get cash for gold, the first thing is don't go to a place named 'Cash for Gold.'"

    remembers that it was illegal for US citizens to hold Gold bullion from the depression to the year Nixon took the US off the Gold standard, and that the price of gold was fixed at, I believe, $45.00 an ounce.

    Funny, the economy seemed to work just fine during that time period.

    Of course, Nixon's abrupt ending of the gold standard (the right thing to do, but in the wrong way) contributed to the 1970's inflation (along with ending the war in Viet Nam).

    No, we better not discuss that, because everybody ignored that component of inflation and that gave the camel's nose a chance to bring supply siders galloping to the rescue.

      business here in s.f. due to the high price of precious metals - including silver.

      platinum is through the roof - gold, too.  silver is no longer easily affordable, so new pieces aren't being made/sold because there is no market in these tight times.

      when i first started doing the jewelry thing, the jewelry mart in s.f. consisted of 2 solid floors of wholesale/manufacturers and another two floors of manufacurers/casters/stone dealers.

      now, the mart is barely one floor of jewelry partly due to the sale of the building and the deliberate attempt to drive out the wholesale jewelry business and turn the center into office space by the cruddy new owners.  the other major reason is the sharp decline in the middle class purchasing fine jewelry.  it is one of the first "luxuries" to go by the boards.  

      so, my major silver supplier is now gone (a lovely married couple with a great shop and great prices) leaving only a very few who now have limited selections.  

      many of the great suppliers are now in l.a. or out of business entirely.  as for the upper floors of gift wholesalers, the majority are now in l.a. or in n.y or at gift shows like moscone.  

      but, the speculators are making a mint!  they are literally killing off their own market in exchange for short term profits.  but, what the heck, the world is going to end when the rapture comes anyway, so what does it matter!  right?

      reminds me of my days in theatre when i was always just one step ahead of "disaster" - learned to live with it and survive.  

      the good thing is that it really pushes my creative buttons to solve problems...

      got a bit slowed down with tee slowing down.  tonite, he is much better, thankfully.  i started him back on triple buffered aspirin this morning and he is much more comfortable.  his restlessness last nite may have been a response to taking him off the pain meds.  he's now snoring in the middle of all his "toyz/babiez".  8^)
