Okay my fellow kossacks. Time to rally the troops again and show who we are. In Arizona on April 3, 2012, Daniel Adkin's Jr. was shoot and killed at a Taco Bell drive thru. Daniel was a mentally challenged person who was 29 years old, yet had the mental state of mind of a 13 year old. Please sign this Change.Org Petition by Daniel's family and help seek justice in this case?
Purportedly, Daniel Adkin's Jr. was going to his local (AZ) Taco Bell while also walking his family pet - a Lab named Lady. The family sensed something was wrong when Animal Control showed up at their home with Lady. They knew Jr. would never leave Lady alone. A man, yet unidentified, said that Daniel Adkin's Jr. was waving his arms in a threatening manner and that he could not leave the drive thru, as the dog was in front of his vehicle. He claimed Daniel hit his vehicle with a steel pipe (that was NEVER found) and he was forced to shoot and kill Daniel.
YouTube video of the local Channel 5 News in Arizona - introduces the story;
Was shooting an act of deadly force or self defense?
Originally, the story by the shooter is that the man and his dog walked in front of his vehicle coming around the corner from the Taco Bell drive thru and was waving his arms about in a threatening manner. The shooter (his name being withheld by the police) - stated that Daniel Jr. had a steel pipe or baseball bat and was hitting his vehicle when he shot Daniel Adkins Jr. to death.
However, NO steel pipe or baseball bat was found at the killing site.
Daniel was waving his arms - when his dog was in front of the vehicle
There are several differents stories here, as there are in the Trayvon Martin/ George Zimmerman saga. According to a CNN story and their apropos 3rd picture in the series entitled "Simple fight, deadly consequences" (here & (here) - this is what purportedly happened;
The shooter pulled out a .40 caliber Smith and Wesson, like this one, and shot Daniel Adkins after he swung his hands in the air. The shooter said he feared for his life.
CNN's article by Mallory Simon and Ann O'Neill delves intofour separate instances asking certain questions and seeking to spark conversations on the Stand Your Ground/ Make My Day laws. The story is titled "Unstable ground: The fine line between self-defense and murder" and it probes such questions as this;
Is the use of deadly force justified when the attacker has no weapon and doesn't touch the person who feels threatened? If an intruder has been subdued, is shooting him or her justified? Can a person chase someone down and then claim self-defense? Are Stand Your Ground laws necessary or were existing laws enough?
There are many good case studies, including (purportedly) the original case that was the specific one used to justify the Stand Your Ground law being put into action. I suggest a read of the entire CNN article (again [
here])
CONCLUSION
It seems to me that these laws are making everyone trigger happy. It is really assinine how ready, willing and able we are to get cocky and kill our fellow man. It is a sad state of affairs.
One could simply and reasonably also conclude that Daniel Jr. was walking the dog, the man almost hit him and the dog and Daniel was waving his arms in a NO NO fashion = for the man to not run over his dog. When the man acted as if he was going forward the mentally challenged Daniel did the only thing he could. Thumping the guys car. Then the man pulled his gun and shot Daniel dead.
If it was a legitimate killing on SYG - why lie and say he had a bat or steel rod?
