After weeks of fast paced progress for marriage equality, this week seems to have slowed down considerably. It could be the election. Who knows? But, that does not mean that there are not numerous issues to be determined in the courts. For example, we are STILL waiting a ruling from the Sixth Circuit with regard to the marriage equality cases that were argued before that panel back in early August. Nevertheless, a few events occurred.
In Florida, AG Pam Bondi wants the Florida Supreme Court to hear the marriage equality cases out of that state as soon as possible. The state's Third District Court of Appeals is considering her "pass through" request. However, they may decide to rule first. Meanwhile, we are still waiting on Judge Hinkle to rule on whether he will lift the stay on the federal marriage equality decision.
The US Court of Appeals For the Fifth Circuit has tentatively scheduled oral arguments from the Texas and Louisiana marriage equality cases the week of January 5, 2015.
A hearing has been rescheduled in the Kansas federal marriage equality case. The judge will hear arguments with regard to the motion for preliminary injunction and the temporary restraining order on October 31 (today). Some were hoping for an order from the bench. That did not happen.
Lambda Legal has filed a notice of appeal to the US Court of Appeals For the First Circuit for the marriage equality case out of Puerto Rico.
In Missouri, the plaintiffs in that federal marriage equality case have withdrawn their request for oral argument and requested that the judge rule on written submissions.
