My post regarding insurance for firearms garnered a few comments that denied that owning a car is a Constitutional right. I beg to differ.
The Ninth Amendment clearly states, "The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people." And the Tenth Amendment states,"The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or the the people."
I shall now use my 10th Amendment power as a free citizen to claim some of my rights under the 9th Amendment. I willingly recognize as valid your claim to the same rights.
I will include some rights I do not claim. I do not recognize any citizen's claim to these rights as valid.
I have the right to decide whom to marry, with their agreement and consent. I have the right to not be married. I have the right to ignore any other citizen who objects to my marriage. I have the right to call for law enforcement protection from a person who attempts to prevent my marriage.
I do not have the right to decide whom you may marry, unless you ask me to marry you. I do not have the right to compel you to marry against your wishes. I do not have the right to object or prevent you from marrying. Some people think they have the right to prevent your marriage if you are gay/lesbian. They don't.
I have the right to buy a home, or rent a home, with the agreement of the seller or landlord, and to buy or rent more than one if I wish.
I do not have the right to decide what home you may buy or how many you may buy. I do have the right to decide what home you may rent, only if I am the landlord.
I have the right to own a vehicle/boat/aircraft of my choice. I also have the right to operate it at any time of day or night on public roads, waterways or airspace if I satisfy guidelines for registration and licensing.
I do not have the right to decide what vehicle/boat/aircraft you may own, or when you may use it.
I have the right to register to vote, and to vote in local, state, and national elections. I have the right to decide for whom to vote. I have the right to decline to vote. I have the right to not be coerced to vote for any person.
I do not have the right to coerce you to vote for any person. I do not have the right to decide for whom you will vote. I do not have the right to prevent you from registering to vote or from voting.
I have the right to procreate, with the willing assent and cooperation of a procreative partner, as often as I wish. I have the right not to procreate.
I do not have the right to decide whether you may procreate, unless you ask me to be a procreative partner. I do not have the right to decide how many times you may procreate, or to compel you to procreate against your wishes. Some people think they have the right to compel their neighbor to procreate against their wishes. They are wrong.
I have the right to pay any merchant involved in commerce a posted or negotiated price to purchase or lease any lawful goods or services of my choice, upon payment of US dollars or other acceptable payment. I have the right to not purchase or lease goods or services. I have the right to purchase or lease similar goods or services from multiple merchants.
I do not have the right to decide whether you may purchase goods or services. I do not have the right to decide how many merchants you purchase or lease from, or what goods and services you may purchase or lease, or to compel you to purchase or lease something against your wishes.
I have a right to act as a merchant in commerce and offer for sale or lease goods or services to any and all persons for a posted or negotiate price upon acceptable payment. I have the right to offer and provide equal service and merchandise to any and all buyers who provide equal payment. I have the right to offer and provide goods and services of different qualities for different prices. I cannot be compelled to sell or lease goods which I do not own or provide services which I am unable to perform.
I do not have the right to act as a merchant in commerce and refuse to sell available, lawful goods or services to any person who has paid or offered to pay the posted or negotiated price. I do not have the right to compel a person to purchase or lease my goods or services against their wishes.
