A few months ago supposedly following up on a promise Pres. Obamas new Atty. Gen. announced to the World a New Policy when it comes to the raiding of Medical Marijuana Dispensaries. This new policy, whose details are still a secret, is claimed to mean that if a Dispensary is following the laws of the State it is doing business in then the Fed will have a hands off policy. Sounds great doesn't it ? Why then are the details of this policy still not put down in writing so everyone can know exactly what the rules are ?
Federal Judge Wu a couple months ago asked the DOJ for a copy of this new policy in writing so he could follow the new policy when he hands down the sentence on Charles Lynch. The DOJ refused to provide the Judge with that written policy and went as far as to say the new policy had no effect on the sentencing of Charles Lynch. Many of us feel like we are back in the Bush era where laws are made and enforced in secret by Presidential order, or where laws are just ignored.
Today at 9:30 in the Federal Courthouse in Los Angeles we will see if Pres. Obama is a man of his word or not. Charles is to be sentenced then and he faces a sentence that is up to 75 yrs in a Federal Prison for following the laws of the State of California.
When Charles was last to be sentenced the Media got involved in a fairly public way. Al Roker, John Stossell, Drew Carrey, CNBC, MSNBC, and many others either did extended video interviews and reports on Charles case. Like with any other item of news the passage of time, new stories,and other reasons have pushed his story to the end on the line. At the last Sentencing Hearing before Judge Wu, the Judge sent Charles attys home to write briefs on how he could avoid the Mandatory Fed. Min. sentencing laws. Judge WU had denied even the term "Medical Marijuana" banned from the courtroom and even had the Witness Statements edited to delete any mention of medical marijuana or Calif. Law. Since then he has courageously changed his outlook somewhat. Today we will know if the Attys were successful and how far the Judge is willing to go. The Judge, the DOJ, AG Holder, and even Pres. Obama have received hundreds if not thousands of letters, emails and faxes on this case so it's not as if they can claim ignorance to the facts.
In the Los Angeles area there are about 600 open dispensarys alone doing business on a daily basis yet Charles may be sentenced to 75 yrs for doing the exact same thing tho possibly in a more upright and legal. This could not possibly be justice could it ?
In recent months we have seen the new DOJ take some major moves to right miscarriages of justice that had taken place against Republican Victims such as Ted Stevens, and several others involved in that case. The strange part imho is that we have seen no such movement in cases that have involved Democrats like the former Gov. Siegelman where the injustice is even more outrageous. Now would be a good first step in restoring the Publics faith in the DOJ and even in the President himself.
If Charles receives anything more than probation or a suspended sentence I would hope that others will join me in demanding that Pres. Obama pardon or commute the sentence of Charles Lynch.

Sentencing Update :
The owner of a Morro Bay pot dispensary who emerged as a key figure in the national debate over medical marijuana was sentenced to one year and one day in prison today by a federal judge in Los Angeles.
Charles Lynch, 47, dressed in a dark suit, sat with his hands clasped and stared straight ahead as the sentence was imposed by U.S. District Court Judge George H. Wu. Lynch declined the opportunity to address the court moments earlier. His mother, seated in the courtroom gallery nearby, fought back tears as Wu said he saw no way around imposing a sentence of at least one year.
