It's official (Final Stay Order).
Judge Vaughn Walker, Chief Judge of the United States District Court for the Northern District of California, ruled last week that California's Proposition 8 was unconstitutional and he reaffirmed today that there is no compelling reason to prevent gay and lesbian couples from marrying. Consequently, the stay is lifted and same-sex marriages can and should resume (EDITED - not immediately but...) next week.

Proposition 8 was ruled unconstitutional last week, but the judgment was delayed (until today) by order of the Court until a motion to stay pending appeal could be resolved.
In the interim, California Governor Arnold Schwarzenegger and Attorney General Jerry Brown filed motions, calling for the resumption of same-sex weddings.
Some couples were already lined up outside the San Francisco Registrar-Recorder / County clerk's officer in anticipation of this news.
Congrats to all on this hard-fought victory for civil liberties (now on to the appeals and the Supreme Court).

"judgment shall be stayed until August 18, 2010 at 5 p.m PDT at which time defendants and all persons under their control or supervision shall cease to apply or enforce Proposition 8.
