Warren and Maureen Nyerges purchased a house from Bank of America for cash, never getting nor needing a Mortgage. BoA in its infinite wisdom screwed up and issued a foreclosure through their attorney. The Nyerges fought and sued the bank, finally winning a judgment after a year and a half of legal wrangling. The Collier County Judge ordered the bank to pay the Nyerges legal fees of $2,534 for the "error". Five months later the bank had still not paid the judgment, so the Nyerges had their attorney do what the bank would have done, seize their assets.
The couple along with their attorney, Collier County deputies and movers with moving vans showed up at the bank branch that handled the "foreclosure".
"I instructed the deputy to go in and take desks, computers, copiers, filing cabinets, including cash in the drawers," stated Attorney Todd Allen
Allen says the manager was visibly shaken, "Having two Sheriff's deputies sitting across your desk, and a lawyer standing behind them, demanding whatever assets are in the bank can be intimidating. But, so is having your home foreclosed on when it wasn't right."
After an hour or so, the bank finally cut a check to satisfy the judgment and no assets were seized. Later the bank issued a statement saying it was sorry that there was a delay in issuing the funds claiming it wasn't their fault as the "Original request went to an outside attorney who is no longer in business".
As for Allen, he calls this a symptom of a larger problem he sees often in the courts, where banks don't perform their due diligence on foreclosure cases. "As a foreclosure defense attorney this is sweet justice."
