On the basis of being a tax.
The Supreme Court upholds the Affordable Care Act 5-4 with Justice Roberts voting in favor.
The AP is reporting:
'The Supreme Court has upheld the individual Mandate"
"The supreme Court has handed President Obama an Election season victory"
From SCOTUSBLOG
The bottom line: the entire ACA is upheld, with the exception that the federal government's power to terminate states' Medicaid funds is narrowly read.
Mitt Romney says - I was for the individual mandate before President Obama was and I would have done the same thing.
LOL @ John Boehner who said yesterday, they would get to work repealing 'what's left' of 'Obamacare'. Good thing he warned his constituency not to spike the football when they 'win'.
“[I]f the Court strikes down all or part of the president’s health care law, there will be no spiking of the ball,” Boehner wrote in the memo. “Republicans are focused on the economy—and under President Obama’s policies, our economy is struggling. We will not celebrate at a time when millions of our fellow Americans remain out of work, the national debt has exceeded the size of our nation’s economy, health costs continue to rise, and small businesses are struggling to hire.”
And Romney now has his work cut out for him.
If Obamacare is not deemed constitutional, then the first three and a half years of this president's term will have been wasted on something that has not helped the American people," Romney told a crowd of some 1,500 supporters here today. "If it is deemed to stand, then I'll tell you one thing. Then we'll have to have a president, and I'm that one, that's gonna get rid of Obamacare. We're gonna stop it on day one."
Romney said Obama would 'wasted' his first term if ACA was struck down. I guess President Obama didn't 'waste' his first term'.
