Does anybody else remember that way back in March, AG Jefferson “Racist Keebler Elf” Sessions offered to resign, but was denied by the so-called-Pr*sident? I wonder what changed…
Anyway, it seems abundantly clear that the popular vote loser now wants Sessions to GO AWAY. There has been a lot of speculation as to why Rumplethinskin doesn’t just fire the little guy. Many seem to think it would be the last straw to cause moderate Republicans in the House and Senate to bolt from protecting the spray-tanned schmuck. I have a hard time believing that DJT gives a FDF about what other people think. I think it’s much more devious.
According to the Federal Vacancies Reform Act of 1998:
(a) If an officer of an Executive agency...whose appointment to office is required to be made by the President, by and with the advice and consent of the Senate, dies, resigns, or is otherwise unable to perform the functions and duties of the office—
(1) the first assistant to the office of such officer shall perform the functions and duties of the office temporarily in an acting capacity subject to the time limitations of section 3346;
(2) notwithstanding paragraph (1),
the President (and only the President)
may direct a person who serves in an office for which appointment is required to be made by the President, by and with the advice and consent of the Senate,
to perform the functions and duties of the vacant office temporarily in an acting capacity subject to the time limitations of section 3346
My emphasis. There are some other rules and restrictions but the bottom line to me is this:
If the AG resigns, the so-called-Pr*sident can appoint someone from another office who has already been confirmed by the Senate to be the temporary AG, just long enough to fire the special counsel. There would be no Senate confirmation hearing, no questions asked, no opportunity for Democrats to ask the new guy, under oath, will you fire Robert Mueller. Senate Democrats are currently working on a plan to prevent any recess appointments, just in case, but this would circumvent that as well.
This plan doesn’t work if the AG is fired.
I’ve tried digging around to make sure I'm reading this correctly, and this article seems to think that it is possible. All he would have to do is find a current cabinet member without any ties to Russia...which actually may be harder than it sounds.
