Basically, Chemerinsky argues that the unequal apportionment in the Electoral College violates the implicit equal protection component of the Fifth Amendment and that the winner-take-all system for determining electoral votes apparently violates the equal protection clause of the 14th Amendment.
Also, is there anything in the U.S. Constitution which states that explicit parts of it will not be amended or repealed by implication (especially implication from vague later Constitutional text)?
