Karma is coming hard and fast for Mark D’Amico and Kate McClure these days. The couple, accused of mishandling nearly $400,000 in GoFundMe donations for a homeless veteran, will likely face criminal charges, their soon-to-be former attorney told the courts in a motion filed last Thursday and released on Monday.
After authorities executed a search warrant last Thursday at the home of Mark D'Amico and Katelyn McClure, Ernest Badway of Fox Rothschild said the firm may not be able to represent the couple because one or both may be indicted, according to a motion filed in court.
"...Since it is expected that one or both of the Defendants will likely be indicted, my firm and I will no longer be able to continue our representation of them in this matter," the filing says.
The filing did not include any further explanation.
The couple is under investigation after John Bobbitt, the beneficiary of their ultra-successful crowdfunding campaign, accused them of withholding money donated by over 14,200 people back in late 2017, after he helped out a stranded McClure, who had run out of gas in Philadelphia. Journalist Chad Pradelli of ABC6 has been quietly monitoring the couple since January, after receiving a tip that they were suddenly living a life of luxury not easily afforded on the sorts of salaries brought in by a state employee and carpenter.
While the case against McClure and D’Amico—initially a civil matter—plods its way through the courts, GoFundMe has made multiple statements promising to honor the fundraiser’s original intent, and promising that Bobbitt will be “made whole.”
Beyond a tearful appearance on Megyn Kelly TODAY wherein they insisted that they’d done nothing wrong and that there was “at least $150,000” left, the alleged grifters have offered no comment to the press and have yet to appear at a single hearing.
According to his attorneys, Bobbitt entered a 30-day residential rehab program on Friday, thanks in no small part to GoFundMe. The nonprofit doled out $20,000 to Bobbitt’s attorneys to ensure his survival while the investigation proceeds.
