House Speaker Pelosi needs to up the pressure on Republican members of Congress, both House and Senate, by filing a formal motion of censure against the President for the Donald J. Trump Foundation’s admitted $2.8 million fraud in New York State. He admitted to the fraud in a settlement last month with Justice Saliann Scarpulla of the New York State Supreme Court in Manhattan, announced on November 5, 2019. There are no disputed facts. The court established the facts — and Trump caved and admitted the fraud and paid a $2 million settlement (a.k.a. fine). His children (Donald Jr., Eric and Ivanka — who were officers of the fraudulent foundation) were required to take court-ordered ethics training to prevent their committing similar misdeeds in the future. If Trump ever tries to run another “charity” in the future, he must follow strict rules set out by the court, and agreed to by Trump, in the settlement.

He fraudulently raised $2.8 million at an Iowa fund-raiser in January 2016, right before the Iowa caucuses. Instead of using funds raised by the Foundation for proper charitable purposes, the Foundation used foundation funds over the years to settle legal obligations of companies he owned, including Mar-a-Lago and the Trump National Golf Club in Westchester County, NY. Trump admitted that the foundation purchased the $10,000 portrait of Mr. Trump, which was ultimately displayed at one of his Florida hotels.
Trump admitted wrongdoing in the court papers on October 1. He cannot claim otherwise — or he opens himself up to a new charge of a false official statement to the court in the formal settlement his attorneys signed.
