UPDATED:
Reader gharlane brought up some excellent points (and gets extra points for posting them at 3:15am (Holy cow for cogent thought at THAT hour!). My diary went with the best info available at the time, but we can now revise and extend things.
A) While the story made the news yesterday, apparently the ruling by Judge Ross was made earlier this week. Hence, any significance to a Sunday ruling needs to be wadded up and thrown out, and I will be the first wad and throw.
B) The ruling itself is embedded and readable HERE,
on the website of Atlanta Channel 11 TV. The news, and the ruling, while good, are not as dunked a slam as I/we hoped. Judge Ross notes Kemp had moved for a Summary Judgement (dismissal of the suit.)
Judge Ross ruled AGAINST Kemp on this. "The Court disagrees," Ross said in her summary, "finding sufficient evidence in the record that would cast a genuine dispute as to the material facts on this issue."
Then the Judge moves to “put Kemp on notice” (judicial for “now hear this!”) that she is considering summary judgement FOR PALAST, gave Kemp 30 days to come up with reasons why not, and 14 days after that for Palast to answer why she should.
So, if everyone takes the max, that takes us to the end of March. So this is hopeful, but not as good as it looked.
