Folks, Supreme Court Justice Stephen Breyer has done something highly unusual for the normally mild-mannered judge—writing the dissent for the court’s 5-4 ruling to overturn decades of precedent in a case regarding tax law and state sovereignty, Breyer plainly noted this “decision can only cause one to wonder which cases the Court will overrule next.” In short, this is a warning shot from the new conservative majority on the bench and Roe v. Wade is being tee’d up to be overturned, among others.
Former Obama White House lawyer Daniel Jacobsen noted on Twitter just how unprecedented Breyer’s comments truly are for a Supreme Court justice.
