MSNBC legal analyst Glenn Kirschner — a former U.S. Army prosecutor — thinks that the DOJ is investigating Trump for his part in fomenting the Jan 6th insurrection, and Trump will be held accountable for his actions.
MSNBC and NBC News legal analyst and former federal prosecutor Glenn Kirschner told SiriusXM host Dean Obeidallah that former President Donald Trump is on his way to being charged for inciting the deadly Capitol insurrection.
I’m all for that. I think if we all had to pick one thing that we would want Trump tried and convicted for it would be the Jan 6th insurrection. Yes, I would thrilled if Trump was charged and convicted for jay walking, but Jan 6th insurrection is the crime that Trump committed that was the most serious. And in fact, HE IS STILL TRYING TO OVERTHROW OUR DEMOCRACY!
Some laugh about his latest attempt to be “reinstated” in August, but this is another slow motion insurrection. Trump is using state legislatures dominated by Trump lunatics to somehow decertify the 2020 Election results. The AZ Fraudit is spreading to other states. And when this gets going, Trump fanatics will manufacture evidence of election “fraud.”
When Trump is not “reinstated” after August, there will be more violence against state governments and in D.C. Trump will whip his delusion and racist followers to attack any seat of power that does not go along with overthrowing our democracy.
This is why I think that busting Trump for insurrection is so important.
However, I am not a lawyer. I think that it is obvious that Trump committed sedition and insurrection. And I think that all the evidence is out there for even the blind to see. Unfortunately, we are dealing with the law. And what I think is illegal doesn’t matter to law enforecement.
This is why I was at least encouraged to read this from Kirschner:
Dean: What would it take for what Trump said and what these guys [the Oath Keepers recently charged] believe for the necessary evidence to be there for Trump to be charged?
Glenn: So it would take what we saw in that 38-page superseding indictment: the date for the insurrection was chosen by Donald Trump, they were incited to violence by Donald Trump and I think you have all of the building blocks you need for a charge of inciting insurrection against Donald Trump. And as to seditious conspiracy, you know they’re still building to that. A conspiracy is an agreement between two or more people to commit a crime and then one of the conspirators taking an act toward the Commission of that crime called an overt act.
You know, when you have, this is more of what I would say is a call and response conspiracy; the leader said I want you to come to DC, it will be “wild.” I want you to assemble, now that you’re here I’m going to lift you up here are my mouthpieces: Don, Jr, Mo Brooks, Giuliani, they’re going to tell you things like go down there and have trial by combat, fight for your vote because they’re in that building stealing it. Now I, as the inciter in chief, am telling you get down to the Capitol and stop what’s going on in that building.
Makes sense to me, but once again, I am no lawyer. And cynics and pessimists rightly point out how very powerful politicians have gotten away with all types of crimes (Nixon in Watergate, Reagan and Bush with Iran-Contra, and George W. Bush with the Iraq War and use of torture on supposed terrorists). The “Get Out of Jail Free” card for presidents has been supported by both political parties (Democrats let Reagan and both Bush’s off the hook).
This is why many are depsondent that Trump will ever face justice, at least when it comes from the federal government.
But Kirshner argues that Merrick Garland has talked about why his grandparents fled Russia. It was anti-Semitism. And given that more than a few Trump fanatics are racists and anti-Semites, Garland may not be inclinced to do the Washington two step of live and let live.
Sorry about this pun, but the jury is still out on what the DOJ may do. But it was encouraging to listen to what Kirshner had to say. Maybe we all might get a little bit of justice?
