A proposed thought experiment for constitutional lawyers, constitutional law professors, and constitutional law students:
1. Replace the members of SCOTUS who were seated in 1954 when it decided Brown v. Board of Education with the current members of SCOTUS.
2. Determine the opinion that this “2024 in 1954 SCOTUS” would have issued [how each would have voted, based on careful analysis of the opinions of the 2024 justices].
3. Write an opinion for each of the current justices as though they were sitting in 1954. Keep in mind that the Brown v. Board decision was based at least in part on the 14th Amendment.
