Now that SCOTUS has granted the President greatly expanded powers, everything they’ve blocked during his Presidency now has a VERY green light to go forward. SCOTUS says that all “core” presidential activity is allowed:
- Student loan forgiveness: SCOTUS says there should absolutely be no “hesitation to execute the duties of his office fearlessly and fairly”
- EPA’s Good Neighbor program: The ruling ensures that the President may exercise those powers forcefully”
- all of the other rulings that SCOTUS has blocked
Because if freedom from criminal prosecution is completely allowed for all official acts, then freedom to execute all of Biden’s agenda is also allowed. After all, criminal prosecution is a threat to take the President’s physical liberty from him. That is a very, very high bar on what he cannot do. But it also means that everything short of that is legal and absolutely within his authority to do.
The administration should refile all of its previous submissions, quoting SCOTUS’ own words back to them. They should argue that, given this new expanded authority, all of their previous rulings against him should be reversed.
This is also strategically important for the country and probably the quickest way to get limitations and constraints on the power of the president. This dumpster diving, sham majority of “justices” will very quickly put up guardrails against him. Oops, they just went on vacation — oh well, they’ve just made him king for 3 months. However, if Biden just went ahead with everything they’ve ruled against him on, I wouldn’t be surprised if they “suddenly” just had a special session to stop him.
But Biden absolutely should go forward with everything that SCOTUS has blocked. Now with the Supreme Court’s explicit blessing.
