Important question for any and all legal types here, and also (via “X”/Twitter) @CREWcrew @TheDemocrats @TheJusticeDept @ACLU: Can you examine Executive Order 13526 in addition to color of law rulings to clarify an approach which legally/legitimately undermines SCOTUS's attempt to provide cover for Trump's crimes thru #FalseImmunity?
For anyone who may need a couple references:
- Executive Order 13526 - Classified National Security Information [https://obamawhitehouse.archives.gov/the-press-office/executive-order-classified-national-security-information]
Ordered/signed by BARACK OBAMA, THE WHITE HOUSE, December 29, 2009
- color of law - definition provided by the Cornell Law School, last updated in July 2022 by the Wex Definitions Team [https://www.law.cornell.edu/wex/color_of_law]
Effectively, prove that the law & Constitution expect the President to be held liable for high crimes & misdemeanors (U.S. Constitution, impeachment & subsequent prosecution) so absolute immunity is not & cannot be constitutionally provided; in addition, declaring actions taken under the guise of "official duties" where the sole purpose is to hide or commit crimes invalidates any claim of "immunity" otherwise provided or conferred by an official duty.
The President is not, and can never be, above the law. A President must faithfully execute duties of the office preserve, protect & defend the Constitution.
