U.S. District Judge Aileen Cannon on Saturday granted former President Donald Trump’s request for further briefing on the issue of presidential immunity in the Mar-a-Lago classified documents case and delayed certain deadlines.
Cannon’s order marks the latest fallout from the Supreme Court’s presidential immunity decision on Monday, which ruled that Trump has immunity from prosecution for some conduct as president in the federal election interference case.
In the order, Cannon afforded special counsel Jack Smith the right, but not the obligation, to file a submission on the use of classified information at trial. At the same time, she paused two upcoming deadlines for Trump and his co-defendants.
Smith’s brief is now due on July 18, and a reply from Trump’s team is due on July 21.
IANAL, but I’m betting Trump’s argument will be this: I was president when I rightfully took those classified documents, and action stemming from my taking those documents is covered under the SCOTUS immunity decision for presidents.
Never mind that Trump was NOT president when he obstructed the government from taking back the classified documents. How does stealing documents from the government fall under the insane rubric of “official acts”? According to that turd Roberts, a president not having the necessary classified documents to make national security decisions would inhibit the power of the presidency (Remember all the talk about the presidency not being “robust” enough?).
Frankly, this will be another pointless hearing from the Queen of Pointless Judicial Hearings, which is the whole point of this latest exercise.
Meanwhile, no ruling on modifying the bond arrangement for Trump that was proposed by Jack Smith. You know the one that was supposed to keep Trump from threatening FBI agents and employees. No rush on trying to protect government witnesses.
