I was reading Madfloridian's blog on DemocraticUnderground, and came across this story. Doing a quick search here brought up no mention of the protagonist of this nonsense, Victor Dimaio, so, not knowing exactly how to bring the subject up, I decided a diary post was in order.

It seems that Dimaio and attorney Michael Steinberg, in a new attempt to get all of Florida's delegates seated, based upon the result of the January 29th contest, are claiming that because the DNC decided to allow South Carolina and Nevada to move their primaries to before February fifth due to their high percentage of minorities, they violated federal civil rights laws. This would be based on the fact that the Democratic Party receives some federal funding that is used to hold their convention.
This is being filed as an amendment to their appeal of their suit from last August that failed in the Appeals Court in Atlanta.
So, here we have democratic activists deliberately trying to get the court to rule against affirmative action.
The lawsuit is due to be heard on May 28th, and if it fails they plan to invoke Rule 11, in hopes of taking the case out of the hands of the Appeals Court, and directly to the Supreme Court.
This is not their first foray into the courts on the issue of Florida's delegates, and their are at least two other groups that are trying, or have tried to do so, all without success thus far.
