[Five Years Into The RIAA's War Against Its Own Customers.....]
Five years ago this month, the Recording Industry Association of America (RIAA, a trade group that represents the major record labels) began a policy of suing individuals they suspect of copyright infringement that has resulted in over 30,000 lawsuits against targets that include the "elderly, students, children and even the dead." In spite of these lawsuits, which has resulted in only one jury trial victory (and even that may be headed toward a mistrial), billions of tracks are still exchanged over Ted Stevens' series of tubes.
So what does the litigation achieve? They are basically using the legal system for extortion. There's a very good piece that was written by Wired recently, which goes through the ins & outs.
"It costs more to hire a lawyer to defend these cases than take the settlement," agrees Lory Lybeck, a Washington State attorney, who is leading a prospective class-action against the RIAA for engaging in what he says is "sham" litigation tactics. "That's an important part of what's going on. The recording industry is setting a price where you know they cannot hire lawyers. It's a pretty well-designed system whereby people are not allowed any effective participation in one of the three prongs in the federal government."
Settlement payments can be made on a website, where the funds are used to sue more defendants. None of the money is paid to artists.
All of this comes at a point many consider a horrible time for the music industry. Album sales have been on the decline for most of the decade. Of course most of the music industry blames this on the "leakage" from file-sharing, and not the quality of their product or their dependence on a sales model that doesn't work anymore. The music industry has also been fighting websites that arguably may help their sales. Over at Advertising Age, they have a piece entitled "How the Music Business Spent the Summer Killing Itself", in which the RIAA's move against internet radio is discussed.
The deeply troubled music industry, rather astonishingly, has been spending its summer making it harder for music fans to encounter new music online. Last month, for instance, Muxtape, which I raved about in this column when it launched earlier this year, went dark. Created by former college-radio DJ Justin Ouellette, the hipster favorite made it simple for music fans to create virtual mix tapes -- short lists of songs your friends (and other Muxtape users) could listen to but not download, because Muxtape used streaming technology. (Muxtape, in fact, offered links to Amazon's MP3 store to make it easy for users to buy songs they had just heard.) But now, a simple, sad message appears on the Muxtape home page: "Muxtape will be unavailable for a brief period while we sort out a problem with the RIAA" -- the Recording Industry Association of America. A brief period? We'll see.
Likewise, the hugely popular internet radio station Pandora is "approaching a pull-the-plug kind of decision," as founder Tim Westergren told The Washington Post, because the federal government, prompted by the music industry, doubled the "performance-royalty" rate that internet radio stations must pay (to record companies) to stream music -- twice as much as satellite radio. Traditional terrestrial radio stations, mind you, don't have to pay performance royalties: They pay only publishing royalties to songwriters. The new internet-radio royalty rates kicked in as of July, and they threaten to kill not just Pandora but the rest of the fledgling internet-radio market.
Meanwhile, we're seeing artists and labels pulling music from iTunes in hopes of juicing album sales.

While reading
Wired's article, one thing that struck me are the similarities to the
"Drug War". You've got the belief that targeting a college kid who downloaded 10 tracks to his dorm room is achieving something; in the same way there are some who think locking up some crack head user for years in the state penn does something significant to slow the drug trade.
So what happens when you have a business model that is failing, and a litigation policy that does nothing to correct the file-sharing problem? As we learned this week, you get the United States government & taxpayers to deal with it. Last week, the Senate Judiciary Committee chaired by Senator Patrick Leahy (D-Vermont) passed the Enforcement of Intellectual Property Rights Act of 2008. It would allow the Justice Department to take over the RIAA's civil suits.
Critics have blasted this provision as a gift of free, taxpayer-funded legal services to content owners. The bill now goes to the full Senate, and must still be recognized with its counterpart legislation in the House, which lacks the language deputizing the DoJ to bring suit on behalf of IP owners.
And if that wasn't enough, the music industry is now left pinning its hopes on MySpace......

Let's Talk Television: The new Fall television season has just recently begun. Since I'm still sorta Human, I can't see everything, but I thought I would offer some takes on the shows I have been able to catch.
There's been a lot of mixed reviews for Executive producer & series creator Alan Ball's (Six Feet Under, American Beauty) new show, but HBO is standing behind it & has already committed to a second season. Based on Charlaine Harris' Southern Vampire series of books, it posits a world in which Vampires have "come out of the coffin" after the development of artificial blood. The Vampire community becomes another minority group in society, with all the issues that creates. Set in the small Louisiana town of Bon Temps, the series is centered on Sookie Stackhouse (Anna Paquin). Sookie is a young girl who's special too, with the ability to read the thoughts of people throughout her entire life except for one person, 173-year-old vampire Bill Compton (Stephen Moyer), who is trying to start anew in the town. A connection forms between them & it gets somewhat Angel & Buffy-ish.
What works? To me the show is at its most interesting when it shows the Vampires attempting to merge into everyday life, and having to deal with societal questions (i.e. If Vampires really existed and wanted to join society, should they have equal rights to Humans?). What doesn't work? Some of the attempts at "southern" humor, and the accents are just bad. My mother is from Mississippi & I spent some of my years growing up in Tennessee, and just to let you know, we don't all speak like "The Beverly Hillbillies". Of course, it gets worse when any show or movie is set in Louisiana. Good actors start to sound like they're in a high-school production of Streetcar Named Desire (Damn You Tennessee Williams).
Some have seen a subtext of the Vampires being stand-ins for Homosexuals, since Vampires would cut across ethnic, racial, religious, and class divides in the same way Homosexuality does. However, I'm not sure the analogy holds. For one, at the end of the day Homosexuals are still Human and don't by nature kill people like cattle. I found myself debating the hypothetical of whether I would support extending equal rights to Vamps while watching the show, and I don't think I would. It would be like Chickens getting together to offer "Chicken Rights" to Colonel Sanders and the workers of KFC.
The boys are back, but all is not well for Vince (Adrian Grenier) & his crew. Each season seems to represent a segment of the Hollywood cycle. The first season was building Vince's career. The second season was trying to get the blockbuster role & becoming a superstar. The third season was dealing with superstar status. Fourth season was making the flop, and the Fifth season is now Vince's attempt at making a comeback off the flop. One nitpick I have with the show is Ari Gold (Jeremy Piven). The performance by Piven is always great, but isn't Ari supposed to be a "Super Agent"? Probably since the end of Season 2, Ari has been more a bumbler, who either screws up deals or is always surprised by info he doesn't (but should) know in meetings. It's interesting that as the show has progressed "E" (Kevin Connolly) has become more & more like Ari. Also, I want to know which Mexican beach Vince was on in the first episode this season, where you can live in a hut with hot women & hammocks for $79 a day?
What a tangled web we weave when we practice to deceive. The saga of Vic Mackey & the Strike Team is near its end, and things are as complicated as ever. Looking back at the entire run of the show, and all of the scheming, plotting, killing and thieving done by Mackey and the other members of the Strike Team, you realize how pathetic their situation has become. At the beginning of the series, Vic had the love of his family & his badge, and now he's struggling to hold on to both. The Strike Team is a shadow of what it once was, with former friends who can barely stand each other, and all of the corners cut in the name of "the greater good" for society have done little to nothing to make things better. Farmington is still the same shithole it always was. One scene this season reminded of a similar theme on HBO's "The Wire" of how no good deed goes unpunished. It was when Claudette (CCH Pounder) tries to get through to a young thug (who was involved in the murdered of two innocent people & then celebrated it) only to have the conversation rebound & slap Claudette in the face.
This series has been described as "The Sopranos on Harleys", but it's probably closer in tone to "The Shield" with both shows sharing Executive Producer/Writer Kurt Sutter. Also, from all accounts "Sons Of Anarchy" has been based & structured on Shakespeare's Hamlet, with the lead character of Jax (Charlie Hunnam) beginning to ask questions about his father & the direction of the motorcycle club. The one character that doesn't exactly fit into the Hamlet archetype is probably the most interesting, Katey Sagal's Gemma, who is probably more Lady Macbeth than Gertrude. Gemma is sorta the power behind the throne, collaborates with Jax's stepfather & Sons of Anarchy leader Clay Morrow (Ron Perlman), and has been trying to put a stop to Jax's questions about the past.
Doctor Gregory House (Hugh Laurie) is a brilliant physician who has saved many many lives, but he can also be a selfish, miserable addict. That has been the contradiction of the character since Season 1, and it finally came to a head in the premiere episode of Season 5. Does House really care about anyone, further than what he can use them to achieve, whether it's getting Vicodin, working his brain to get a diagnosis, watching soaps in the lounge, or getting a ride when he's drunk? Wilson (Robert Sean Leonard) has always been the Watson to House's Sherlock Holmes, but no more (or at least for now).
The new "90210" has been blasted by critics, but I think there could be a show there. One problem with the new version is the characters. So far, the only characters that are interesting are either the ones from the original show, or the ones that are in some way connected to the ones from the original show. Most of the "new" characters are just a rehash of things that have been done over and over to death (i.e. the rich girl who has everything but a stable home & happiness, the outsiders trying to fit into Beverly Hills society, etc.). However, it should be noted that if you go back & watch the first season of the original "Beverly Hills, 90210", it wasn't that great. It took Aaron Spelling & Darren Star a little bit to get the hang of it.

Relevancy: I so wanted to write this diary last week, but had absolutely no time to put all of this together. One reason was to talk about this year's MTV Video Music Awards. It was only a few years ago that this awards show (especially when Chris Rock was hosting it) was a huge deal in the music industry. There were stories about how winners & performers would see sales jumps. So what does it say about the state of "Pop" Music & MTV when the big winner at this year's VMA's was Britney Spears for a track that didn't even chart in Billboard's Top 10? I find it interesting that the demise of the music on MTV has largely coincided with the fall in record sales. It was announced earlier this week that TRL is going to be canceled, and that probably should have happened years ago.
This goes back to an argument I've heard about MTV's past power. If you look at what the MTV of the 80s really was, it was a 24/7 commercial for the music industry. There were a whole host of bands from the early '80s who were made by airplay on MTV. People would watch the video on MTV, like it, and then go out and buy the record. Since the advent of the internet, file-sharing, and YouTube, that dynamic has changed. You don't have to rush out to the record store (if they still exist), hope for MTV to play the video in the next rotation, or God forbid wait by the radio. Now you can download it, legally from iTunes or not so legally from somewhere else, or if worse comes to worst listen to it somewhere on the internet with shitty sound quality.
MTV started moving away from music programming in the 90s for "The Real World" & "The Hills", and they're still influential with teens & tweens (if I have to hear about Lauren & Heidi one more time...), but just not really with music. However, look at Disney & BET. The Disney Channel's programming is a hybrid of "High School Musical", Jonas Brothers & Miley Cyrus. BET still plays music videos to some degree, and "106 & Park" is the network's highest rated show.
All of this led those over at Defamer to wonder whether some of the stars that defined MTV would even make it on the channel now? Say Kurt Cobain?
After word emerged yesterday that MTV was planning an extreme dieting beauty pageant, we knew it was time to ask ourselves, "Do we still want our MTV?" Many of us grew up in a time where the network was perceived as alternative, cutting-edge, and cool, though it's hard to picture the stars who made it that way getting a foot through the door of the modern-day MTV casting office.
