Two articles about the recent suicide of an innocent Guantanamo detainee, reveal two ways the Obama administration makes a mockery of the Judicial Branch & "rule of law":
1) Ignoring explicit Judicial orders & rulings
2) Assassinating suspects, instead of indefinitely detaining them or trying to prove their guilt, to avoid the messy legal & political problems
In excellent article, "Another Guantánamo Prisoner Death Highlights Democrats' Hypocrisy," Glenn Greenwald notes that the Obama administration has found a solution to problem of detaining & torturing terrorist suspects. Killing them.
Well, that is certainly a way to avoid judicial review. Greenwald rightly notes that in the hierarchy of Evil, indefinitely detaining an innocent person is up near the top, which is is exactly what the US did to Adnan Latif, who was imprisoned at Guantanamo since 2002, despite being cleared for release in 2004, 2007, 2009 & 2010.
Perhaps, Obama decided murdering suspects is more humane than indefinitely detaining them without charges or trial, which is a 'point' that I am very close to...accepting...
So what was the compelling reason Obama's imprisonment of an innocent man, cleared for release several times since 2004?
"The Obama DOJ appealed the 2010 decision, in part because of a policy of not transferring detainees to Yemen...where he was born."
Well, Yemen is a dangerous country...perhaps Obama's only protecting Latif from harm...
Let the absurd, monstrous, Orwellian logic of that 'justification' sink into your soul for a few seconds...not the 10 years of daily torture suffered by the subject of this story.
It's not that the Obama administration is against following judicial orders to release innocent prisoners, it's just that Obama has a very important inviolable policy of not releasing innocent people if they were born in certain countries, because...well, just because...
It seems Latif was not the only innocent person tortured & imprisoned for 10 years, who can't be released anywhere because they were also born in the wrong countries.
"'Over half of the people left in Gitmo have been cleared for years,' said Cori Crider, Legal Director at Reprieve in charge of managing litigation on secret prisons,who has represented clients detained at Guantanamo. Crider went on to say that although conditions at the prison are better than they were in 2002, indefinite detention is enough to break people."
Imaging being an innocent person tortured in a foreign dungeon and being told that a judge ordered your release, but you could not leave because that foreign country had a strict policy of not releasing prisoners to the USA.
Call me cynical, but I suspect that Obama refuses to release the remaining innocent inmates because he does not want them telling anyone how they were brutally dehumanized, tortured & indefinitely detained despite being proven innocent.
I strongly suggest you read this letter below from Adnan Latif to his lawyer before his suicide, expressing the horrors & inhumanity of indefinite detention were so unbearable that victims are driven to commit suicide, deprived of any hope for getting their humanity & freedom restored, because of the Emperor's wicked, barbaric, disgusting, empty "policy" that trumps human rights & judicial authority.
It gives a glimpse into the unfathomable hell of indefinite detention, a hell that a US Judge Katherine Forrest stridently told the Obama administration it did not have the constitutional power to sendUS journalists, academics & non-violent activists. Obama is appealing the decision, apparently determined to get power to order people into this hell without charges or trial.
Why don't you tell us, Pres. Obama, what do you have to hide so, that you're afraid of courts & trials, where you have to prove someone's guilty? Why is this so onerous a task if you are genuinely detaining those you're absolutely certain are engaged in terrorist violence? Why did your lawyers refuse to assure Judge Forrest that the academics & journalists would not be indefinitely detained at your whim for "supporting" some unnamed "associated forces" of something bad?
Well, we already know Obama will just ignore the US Judiciary if they don't grant him the dictatorial power he needs.
Read this desperate letter from the "indefinite detention" hell Obama obviously wants to send US citizens...possibly to cover up the atrocities already committed against those who've survived torture, persecution, attempted murder, & been denied legal counsel "out in the wild" to deny them access to judicial review...perhaps that's a motive...I'm just speculating based upon what I know & learned...from recent history.
At some point when cruelty, torture, psychological warfare, injustice, inducing objective hopelessness, drives an innocent person to commit suicide, it must be ruled murder. At some point all humans will break and prefer death to escape the pain. Depriving humans of hope & any means to escape the totalitarian matrix where consciousness is torture, exceeding anything the sub-conscious can produce in nightmares, is a hell, with which Satan could not compete.
