Have you seen the story about the judge who let off a du Pont heir who raped his own 3 year old daughter with probation while saying the defendant "will not fare well" in prison?" It's pretty much viral now. And the judge, Jan Jurden, has had to enlist security personnel due to the numerous death threats she has received.
Burn her. She's a witch.
Except this story is wrong. Turns out, the sentencing was part of a plea deal struck by the prosecutor way back in 2009 and the comment, attributed to the judge, was actually a note (almost certainly a notation of the defense attorney's argument for why his client should receive a suspended sentence) and not a statement by the judge.
Now, even knowing all this, one may say, "I don't care. She still should have sentenced him to prison time."
But there's a problem with that. The D.A. can't have judges overturning their plea deals. The whole system would crash. The D.A. made a deal for probation, that's what the defendant gets.
So, maybe you're thinking, "Well, let's lynch the prosecutor for making such a bad deal. And maybe investigate how much du Pont money went to the prosecutor's campaign coffers."
You got me there. here's the thing though. It is highly probable the D.A made that deal because there was a decent chance the defendant would walk if it went to trial. I don't know. And neither do you. I haven't read one lynching article that makes the case that the D.A. showed favoritism. But I would really like to see an investigation.
But that would be an investigation of the prosecutor. Not judge Jurden. Based on the information available at this time, I don't see grounds for even an investigation of the judge.
It is possible that the D.A. did a favor to the du Pont family. And it's possible the the judge was aware of it. If that's the case, I hope someone proves it. I am one who sees our judicial system as the rotten apple from the poison tree of our corrupt political process.
But in the mean time, until someone shows the evidence of wrongdoing, I strongly recommend throwing Judge Jurden into a lake to see if she floats. Then we'll know for sure.
