According to several news sources, including this one, Virginia's recently-elected Attorney General Mark Herring is expected to formally announce later today that his office, upon review, has found Virginia's ban on same-sex marriage (and civil unions, domestic partnerships, and even some private arrangements) is in violation of the US Constitution. Consequently, his office will be arguing on behalf of the plaintiffs in Bostic v. Rainey, one of two Federal challenges to the ban (two county-level court clerks will be defending it) in a hearing next week.
Herring has stated that the ban is still in effect until struck down, and has instructed clerks not to issue marriage licenses to same-sex couples at this time.
