Just in, from The New York Times:
The Supreme Court vacated the part of the Fifth Circuit’s ruling that had let the surgical-center requirement go into effect. It also vacated a second part of the Fifth Circuit’s ruling, concerning the law’s requirement that doctors performing abortions have admitting privileges at a nearby hospital, as it applied to clinics in McAllen, Tex., and El Paso.
The surgical-center requirement, of course, is the idea that somehow, abortion clinics are inherently far more dangerous than other procedures, and therefore must operate as if they were surgical centers (with far more expensive equipment, regulations on things like hallway size, etc.).
Without this stay, there would be only eight abortion clinics in the entire state of Texas. Of course, somehow, reducing access to abortion is somehow "making women safer" in the minds of Texas legislators, whatever the hell that means.
Of course, it should come as little to no surprise that the three who voted against women were Alito, Thomas, and Scalia. As much as I despise Roberts, he at least voted on the right side at this point.
I am sure Rachel Maddow will be talking about this tonight.
