Judge John G. Heyburn II issued a final order that Kentucky must recognize same-sex marriages performed in other states. He did NOT issue a stay of the order.
Attorney General Jack Conway wants a 90 day delay because of the impact of the order.
Heyburn's preliminary ruling on Feb. 12 struck down portions of a 1998 state law and a 2004 state constitutional amendment defining marriage in Kentucky as between one man and one woman, and prohibiting the recognition of same-sex marriages legally performed in other states.

In his 23-page ruling issued Feb. 12, Heyburn concluded that the government may define marriage and attach benefits to it but cannot "impose a traditional or faith-based limitation" without a sufficient justification for it.
"Assigning a religious or traditional rationale for a law does not make it constitutional when that law discriminates against a class of people without other reasons", wrote Heyburn, an appointee of President George H.W. Bush.
