Yes, we’re going to win. We’re going to elect the first woman President.
We’re going to elect an incredibly smart, incredibly disciplined President — someone prepared, serious, passionate, someone who knows how to listen (a rarity in life, it seems) and who will focus on improving the well-being of American families.
And we’re going to get a Democratic Senate that is going to confirm her judges.
So we’re going to have two more years to fill up those juicy appellate courts, and we’re going to get a majority on the Supreme Court that may well last a decade or more.
Which means we’re going to get a court that will back up Hillary Clinton’s use of executive orders and the EPA to combat climate change.
And we’re going to get a court that will overturn Citizen’s United.
And a court that will protect Marriage Equality — anyone want to marry me? I’m still looking — and a woman’s right to control her body.
Will we get a court that makes it easier for individuals to hold Corporations responsible for their exploitation and malfeasance?
Will we get a court to overturn the barbarous practice of state-sponsored execution, aka “the death penalty”?
Will we get a court that will allow that sensible regulation of guns does not violate the second amendment?
Yes, hopefully, and yes.
Will a case come before the Court, having to do with the determination of house districts? (Is it possible that the Supreme Court could rule on gerrymandering?) Or a case to overturn the provision that allows states to opt-out of Obamacare’s Medicaid expansion? Or a case to protect the rights of transgender people?

Dreaming. The possibility of five or six Democratic justices allows one to imagine what might be done in other areas. Might the Court find a constitutional right to education and conclude that disparities in school funding violate the Constitution? Might the Court find that the racial injustices in the criminal-justice system violate equal protection? For so long, progressives have had to focus primarily on keeping the Court from overturning precedents and limiting rights. Justice Scalia’s death and the coming presidential election allows liberals to dream of how much a different Court could do to advance liberty and justice for all.
