Not easy to say exactly which are the terms of what happened today in Catalonia. The media is not giving accurate information then is not easy to link to sources.
First is necessary to remember that is not the President of Catalonia who has the role of declaring the Independence according to the Catalan law for deconnection, is the parliament of Catalonia.

Oct. 5 (UPI) -- The Spanish Constitutional Court banned the Catalan parliament from meeting next week to stop the region from declaring independence.
The ban comes after Catalan President Carles Puigdemont said he would declare independence from the rest of Spain "in a matter of days" following the final referendum vote count. In the referendum this weekend, the Catalan government said, around 2 million of the 2.3 million votes cast backed secession. More than 5 million Catalonians were eligible to vote, but the Spanish government ordered police to raid polling places and seize voting supplies.
The injunction was made after the court unanimously voted to hear an objection to the Parliamentary meeting filed earlier today by the Catalan Socialist party.
The court, made up of 12 magistrates, is headed by Juan José González Rivas, who is part of the same political party as Spanish Prime Minister Mariano Rajoy.
The parliament meeting on Oct. 9 was expected to be Puigdemont's official call for Catalonia's independence.
The ban casts doubt on whether Catalonia will be able to successfully secede from Spain.
Spain's Constitutional Court justified the ban by calling the move to declare independence "a breach of the constitution," as have other Spanish government officials including King Felipe VI.
"It is the responsibility of the legitimate powers of the state to ensure constitutional order and the normal functioning of our institutions, the validity of the state of law and self-government in Catalonia," Felipe said in a speech Wednesday.
Despite it the Parliament of Catalonia, without a meeting declared “to take into account" the results of the Referendum, making official the reception of the results. The President of Catalonia asked to the Parliament for an appearance to analyze the political situation.
The parliament had a meeting today. The President explained his view about the political situation. He said that the procedure of the Catalan law must continue, and the Referéndum is valid and reflects the determination of the people of Catalonia to form an independent republic. He said that Catalonia won the right to be an independent republic the October,1.
And after say it, he also said, that opening a window of several weeks to the dialogue and opening a window to the efforts of mediation that are emerging, he asks to the Parliament of Catalonia to suspend the effects of the declaration by several weeks.
But the most important result of the meeting is the approval and signature of the following declaration, that is the formal Declaration of Independence and opens at same time a way to the dialogue with Spain, with the help of external mediation. La justícia i els drets humans individuals i col·lectius intrínsecs, fonaments irrenunciablesque donen sentit a la legitimitat històrica i a la tradició jurídica i institucional de Catalunya,són la base de la constitució de la República catalana.
La nació catalana, la seva llengua i la seva cultura tenen mil anys d’història. Durant segles,Catalunya s'ha dotat i ha gaudit d'institucions pròpies que han exercit
l’autogovern amb plenitud, amb la Generalitat com a màxima expressió dels drets històrics de Catalunya. El parlamentarisme ha estat, durant els períodes de llibertat, la columna sobre la qual s'hansustentat aquestes institucions, s’ha canalitzat a través de les Corts Catalanes i i hacristal·litzat en les Constitucions de Catalunya.
Catalunya restaura avui la seva plena sobirania, perduda i llargament anhelada, després dedècades d'intentar, honestament i lleialment, la convivència institucional amb els pobles dela península ibèrica.
Des de l’aprovació de la Constitució espanyola de 1978, la política catalana ha tingut un paper clau amb una actitud exemplar, lleial i democràtica envers Espanya, i amb un profund sentit d’Estat.
L’estat espanyol ha respost a aquesta lleialtat amb la denegació del reconeixement deCatalunya com a nació; i ha concedit una autonomia limitada, més administrativa que política i en procés de recentralització; un tractament econòmic profundament injust i unadiscriminació lingüística i cultural.
L’Estatut d’Autonomia, aprovat pel Parlament i el Congrés, i referendat per la ciutadania catalana, havia de ser el nou marc estable i durador de relació bilateral entre Catalunya iEspanya. Però va ser un acord polític trencat per la sentència del Tribunal Constitucional ique fa emergir noves reclamacions ciutadanes.
Recollint les demandes d’una gran majoria de ciutadans de Catalunya, el Parlament, elGovern i la societat civil han demanat repetidament acordar la celebració d’un referèndumd’autodeterminació.
Davant la constatació que les institucions de l’Estat han rebutjat tota negociació, han violentat el principi de democràcia i autonomia, i han ignorat els mecanismes legalsdisponibles a la Constitució, la Generalitat de Catalunya ha convocat un referèndum per a l’exercici del dret a l’autodeterminació reconegut en el dret internacional.
L’organització i celebració del referèndum ha comportat la suspensió de
l’autogovern de Catalunya i l’aplicació de facto de l’estat d’excepció.
La brutal operació policial de caire i estil militar orquestrada per l’estat espanyol contraciutadans catalans ha vulnerat, en moltes i repetides ocasions, les seves llibertats civils i polítiques i els principis dels Drets Humans, i ha contravingut els acords internacionalssignats i ratificats per l’Estat espanyol.
Milers de persones, entre les quals hi ha centenars de càrrecs electes i institucionals i professionals vinculats al sector de la comunicació, l’administració i
la societat civil, hanestat investigades, detingudes, querellades, interrogades i amenaçades amb dures penes de presó.
Les institucions espanyoles, que haurien de romandre neutrals, protegir els drets fonamentals i arbitrar davant del conflicte polític, han esdevingut part i instrument
d’aquests atacs i han deixat indefensa la ciutadania de Catalunya.
Malgrat la violència i la repressió per intentar impedir la celebració d’un procés democràt ici pacífic, els ciutadans de Catalunya han votat majoritàriament a favor de la constitució dela República catalana.
La constitució de la República catalana es fonamenta en la necessitat de protegir lallibertat, la seguretat i la convivència de tots els ciutadans de Catalunya i d’avançar cap aun Estat de dret i una democràcia de més qualitat, i respon a l’impediment per part de l’estat espanyol de fer efectiu el dret a l’autodeterminació dels pobles.
El poble de Catalunya és amant del dret, i el respecte a la llei és i serà una de les pedresangulars de la República. L'estat català acatarà i farà complir legalment totes lesdisposicions que conformen aquesta declaració i garanteix que la seguretat jurídica i elmanteniment dels acords subscrits formarà part de l'esperit fundacional de la Repúblicacatalana.
La constitució de la República és una mà estesa al diàleg. Fent honor a la tradició catalanadel pacte, mantenim el nostre compromís amb l’acord com a forma de resoldre elsconflictes polítics. Alhora, reafirmem la nostra fraternitat i solidaritat amb la resta de pobles del món i, en especial, amb aquells amb qui compartim llengua i cultura i la regióeuromediterrània en defensa de les llibertats individuals i col·lectives.
La República catalana és una oportunitat per corregir els actuals dèficits democràtics isocials i bastir una societat més pròspera, més justa, més segura, més sostenible i més solidària.

amb el mandat rebutde la ciutadania de Catalunya,
CONSTITUÏM la República catalana, com a Estat independent i sobirà, de dret,democràtic i social.
DISPOSEM l’entrada en vigor de la Llei de transitorietat jurídica i fundacional de la
República.
INICIEM el procés constituent, democràtic, de base ciutadana, transversal, participatiu i vinculant.
AFIRMEM la voluntat d’obrir negociacions amb l’estat espanyol, sense condicionants previs, adreçades a establir un règim de col·laboració en benefici de les dues parts. Les negociacions hauran de ser, necessàriament, en peu d’igualtat.
POSEM EN CONEIXEMENT de la comunitat internacional i les autoritats de la UnióEuropea la constitució de la República catalana i la proposta de negociacions amb l’estat espanyol.
INSTEM a la comunitat internacional i les autoritats de la Unió Europea a intervenir per aturar la violació de drets civils i polítics en curs, i a fer el seguiment del procés negociador amb l’Estat espanyol i ser-ne testimonis.
MANIFESTEM la voluntat de construcció d’un projecte europeu que reforci els drets
socials i democràtics de la ciutadania, així com el compromís de continuar aplicant, sense solució de continuïtat i de manera unilateral, les normes de l’ordenament jurídic de la Unió Europea i les de l’ordenament de l’e stat espanyol i de l’autonòmic català que transposen aquesta normativa.
AFIRMEM que Catalunya té la voluntat inequívoca d’integrar-se tan ràpidament com sigui possible a la comunitat internacional. El nou Estat es compromet a respectar les obligacions internacionals que s’apliquen actualment en el seu territori i a continuar sent part dels tractats internacionals dels quals és part el Regne d’Espanya.
APEL·LEM als Estats i a les organitzacions internacionals a reconèixer la República catalana com Estat independent i sobirà.
INSTEM al Govern de la Generalitat a adoptar les mesures necessàries per fer possible la plena efectivitat d’aquesta Declaració d’independència i de les previsions de la Llei de transitorietat jurídica i fundacional de la República.
FEM una crida a tots i cadascun dels ciutadans i ciutadanes de la República catalana a fer-nos dignes de la llibertat que ens hem donat i a construir un Estat que tradueixi en acció i conducta les inspiracions col·lectives.

1. The mission of the Armed Forces, comprising the Army, the Navy and the Air Force, is to guarantee the sovereignty and independence of Spain and to defend its territorial integrity and the constitutional order.
2. The basic structure of military organisation shall be regulated by an organic law in accordance with the principles of the Constitution.
In other words Spain was understanding the Internation Community was allowing them to use the violence. Because this article was included by the old fascism to abuse against Catalonia and the Basque Country.
And this continues being used against Catalonia even after the Referendum and after the international rejection of the violence, by the Spanish minister of Defense.
