File this under the “no shit” category, but also, more smoke for the potential fire that is Trump’s impeachment. Per the Associated Press:
Former National Security Adviser Michael Flynn will invoke his Fifth Amendment protection against self-incrimination as he notifies a Senate panel that he won’t hand over documents in the probe into Russia’s meddling in the 2016 election, according to a person with direct knowledge of the matter.
The notification will come in a letter to the Senate Intelligence committee expected later Monday. The person providing details spoke on condition anonymity in order to discuss private interactions between Flynn and the committee.
Whatever he’s hiding in those documents, Comey’s probably in a position to partially reveal in his public testimony. That’s what I expect anyway. As for the repercussions for Flynn, here’s what Amanda Terkel has been able to unearth:
According to a Congressional Research Service report, Congress has three methods by which it can deal with Flynn’s non-compliance: It can detain and imprison him until he complies, refer him to the executive branch (in this case, the Department of Justice) for criminal prosecution, or seek a civil judgment from a federal court that would compel Flynn to comply.
The Senate intelligence Chair has yet to say which of those options if any he will exercise, and two weeks ago it looked like none was the answer, but we’ll see what Comey says. The mood is shifting in the Country and in Congress.
