Let’s get one thing straight right away there is no part of the US Constitution that protects the Flag, National Anthem, Salute to the Flag or dictates that you must stand, sit, run in place or anything else during the playing of said anthem or salute. It seems the founders thought it was more important to protect the right to protest than a flag. Perhaps they realized that any flag could become a symbol of tyranny as did the British Flag to them.
There is also no right of any employer to make standing during the National Anthem being played in the workplace a condition of employment. That goes for saluting the flag or reciting a passage from the bible or any other religious text. If employers don’t want to see employees kneeling during the National Anthem then don’t play the anthem in the workplace! This whole argument that you don’t have a right to kneel in the workplace is garbage. If your employer insists on playing the anthem in your workplace you have the right to kneel on one knee both knees, run in place, sit, or anything else during that time. Contrary to CONservative opinion Constitutional protections extend into any workplace located in the US or any of it’s territories and to any persons, whether they be citizens or not, located within said boundaries.
So don’t listen to these supposed legal experts who say you don’t have the right to kneel in the workplace! You’ll notice they leave out ‘during the playing of the National Anthem’ when they make that claim!
