Dear GOP:
From the moral, ethical and patriotic points of view, what you’ve done is pretty obviously despicable. We know that and, I think, you do too. But that isn’t the point, is it?
From a political point of view, you’ve done us a huge favor. Let met explain:
If you had dropped Kavanaugh the minute the accusations surfaced (and you probably knew about them before that, which makes your strategy even dumber), a baggage-free Federalist Society-approved justice would be on the SC already. Instead, you doubled down on Kav, and did it in the most obnoxious and ham-handed way possible. Anyone outside of your most Trumpist supporters know this. And—thanks!--you did it all a month before the elections. We know Trump made you do it. Too bad...
Let’s talk about Kavanaugh for a second and let’s make the good assumption that he perjured himself. If the Democrats take the House, Jerry Nadler will go after him. Big time. That’s one front. Another: I am not a lawyer, but it seems likely that the ABA doesn’t like judges who perjure themselves. It’s the kind of thing that lawyers lose their licenses over. What a spectacle: A SC justice fighting to keep his law license. So, it’s a lifetime appointment….maybe.
Now, let’s talk about Justice Roberts for a moment. By all accounts, he cares about the court. He now has three conservative justices with clouds over their heads. The latest, of course, is a big cloud. It is likely he does two things: Becomes more of a swing vote than Kennedy (who was a bit Collins-esque in his MOR credentials) and for the next session or two stays away from the flashpoint cases. He may want things to settle down. Those of you who don’t think this is likely, kindly review his ACA decision. Sure, the individual mandate is a tax.
So we have Democratic enthusiasm, a SC Chief Justice who probably is angry as hell that Congress is sending him a sex criminal/perjurer and, if things go according to the pollster, a Democratic House in a few weeks...
So, folks, it’s obvious you blew it by sticking with this guy. In the meantime, enjoy your sugar high. See you in January.
