UPDATE: Moments ago Walker’s attorney’s informed the state Supreme Court that "the Governor has decided not to seek relief from the Supreme Court at this time.” The call for special elections will move forward tomorrow by noon. Democracy wins!

Gov. Scott Walker won't appeal to the Wisconsin Supreme Court a Wednesday appellate decision denying his request for eight more days to call a special election in two vacant legislative seats.
In a one-page ruling issued hours after the Department of Justice appealed two Dane County judges' decisions on the case, 2nd District Appellate Court Judge Paul F. Reilly dismissed Walker's argument that the court should allow time for the Legislature to rewrite state law, effectively blocking the special elections.
"Representative government and the election of our representatives are never 'unnecessary,' never a 'waste of taxpayer resources,' and the calling of the special elections are as the Governor acknowledges his 'obligation' to follow," Reilly wrote.
The Department of Justice, which represents Walker, informed the court Wednesday afternoon he would not be seeking relief from the Supreme Court at this time. In an earlier court filing DOJ indicated Walker planned to call the special elections for June 12 if his appeal were unsuccessful.
Walker has until noon Thursday to call the elections.
